A creditor has received an order for a liquidation of my company. In the meantime, i would like to pay off the debt as i have received the monies that are owed to me, What do I do?
I should also add I have not received it but the creditor says he has. I am not sure whether it is a provisional or final. I am meeting them on Monday I just wanted to understand. Thanks
It sounds as if a winding up petition has been presented but an order not yet made. I suggest you speak to the creditors solicitors and establish the position. If the petition has not yet been advertised you will be able to pay the debt and the petition can be withdrawn.
Please note time is of the essence and it would be advisable for you to instruct a specialist corporate insolvency solicitor to ensure your company's position is not prejudiced.
